Is this considered to be a rip?

Okay i spent some days now trying to make a nice wallpapers package to complement TSF's great work Alienware Invader.It has 44 walls in total at all possible resolutions (even wide and double screens). I've uploaded it and it got rejected. I've sent mail but got no response,sooo i'm leaving it to public judgement. Is this considered a rip or not? Please do keep in mind that i made all graphics in Photoshop,no copy-paste here,all were redrawned. And trust me space scenes take time to make.

A rip of what Cyber,,theres nothing for anyone to compare it with. I believe that it is your original but there are a lot of similar looking walls to be found. Did reject email say it was rejected because it was a rip or for some other reason?

Some things may be a rip even though they are your own works. For example, I was so inspired by DanilloOc that I wanted to pay tribute to him. I looked at his 3fx wall and did what I could to create a very similar but original wall. Danilo was a gentleman and did not say a word. It was posted on a couple of different sites. Then a good friend of his told me that it would be considered a rip even though my intentions were good, basically I stole an idea. I did not argue it, apologized and removed my submissions. Here is his (of course, incredible work) and my attempt to pay homage.





My only point being that original stroke marks can still be a rip of ideas, and although you may win a suit if pursued, it might be the right thing to remove it.


All of that being said, I have no idea why your wall was rejected. It is very similar to the Alien Invader wall, but clearly different. It's good work, but maybe rejected for another reason.


Just thinking out loud, Cyber. Only the rejecter can tell you for sure.

Haven't been able to access the Mod Queue for 3 days....till today...[darn these weekends]...so haven't seen the submission at all....

Buzzh58 the rejection mail just says that it violates guidelines. Only guideline broken is the originality thing. And i think it is a pretty obvious the inspiration-intented to be used as wall for Alienware Invader. Maybe is considered idea rip as SD said,dunno for sure...btw SD nice work,original one,yet so similar,but since it was done without you knowing about the original work i guess that is just to say it is original. Thank you for the quick responce guys...

...but i shall wait as Jafo said...

Am just looking for it....my first thought is that it's the old issue of 'space scenes are the hardest things to pull off well.....[I remember kicking BoXXi's attempts, ages ago]...

I think downloading 3+ meg of 44 versions of essentially the same wall is a bit of a stumbling block.Perhaps there were just too many versions/sizes....and therefore too much 'bloat' for such a simple wall image.  1088x612 ?.....hardly a common resolution....

the mods here get tons of uploads every day to deal with. so many that they cant send an explination to each that is rejected.
also most of the mods here are volinteers so it may take a while to get a response to an e mail asking why it was rejected .. typically after an e mail is recieved the mod who recieved it talks to the mod who rejected it to see if they can get an answer for you ... some times it may take a while for 2 mods to actually run in to each other ...further delaying the reply you are wating for ....

the wall in question may have been rejected for many reasons 'looking at that specific wall I doubt they were thinking rip" it dont exactly look like any wall TSF has made . nor does it have any alien faces or any other imagery to imply that it would be "inspired"...it could have been rejected for many other reasons

I thought that was it's strong part...the fact that it comes in four designs at all possible resolutions...and is only 3 MB's.

640x480 (eek)

1024x768
1280x960
1280x1024 (different aspect ratio)
1600x1200


Actually these are the offered ones:

Normal Screen:
- 800x600
- 1024x768
- 1280x960
- 1600x1200

Wide Screen:
- 1088x612
- 1280x720
- 1280x768

Double Screen:

- 1600x600
- 2048x768
- 2560x960
- 3200x1200

But like Jafo said,it must have been simple too much...

It's not up to the public to determine if something is a rip. If i didn't answer you that doesn't give you the right to still post things asking the public for their opinion. Because in the end if you ripped TSF it wouldn't be the public we'd sue it would be you. Catch my drift? I don't consider your space scene a rip but i want you to remove the blue lines on top and bottom which is from the logo we created. I don't want people to assume this was sanctioned by us or Alienware.

That would be my guess as to why the email said it violated the guidelines. Maybe too many walls in one package.

Outdated? I'm still using an 800x600 monitor and forcing myself to adjust to 1024x768 resolution. Just how big do people need their monitors? The size of the entire desk? It's not a television.

I don't ask the public for permission. I only would like to know why is been rejected, also i'd like to know when copy-rights are disturbed or not. I didn't ask for any permissions so i'm not waiting any answer from you. Anw since copy-rights seem to hurt you i won't try to upload it. I'll also take down the shot in my Personal Site.

More like a home-cinema!!! Hmmm...that sounds like an idea.... Wish i had money to update my monitor...still on 17" CRT.

Those 'really' are all that are needed, at most.

Considering the simplicity [and darkness] of that wall....any one size OR aspect ratio could have been used via 'stretch' to desktop and no-one would have been the wiser....

Its a shame that everyone can't be polite like you are Cyberworld.

So size of d/load was not the factor..but, keep in mind..for me most wall downloads take 12 to 20 minutes if too many sizes are in Zip. Which is why its most appreciated when the preview is a savable 800x600 or 1024 version. Although I notice some are putting logos through samples because they insist you download a 5 mb zip. Just makes me not bother.

I always include 1920 x 1200.

Cyberworld: i misread what you wrote. I thought you meant you sent me an email and i didn't answer it considering the title of this forum post was "is this a rip". Just remove the blue bars and upload it. Stupid to spend all that time on something and not release it.

Jeff, are you out of your mind? That wall in no way is any sort of rip or intellectual 'theft' of yours.

If you're willing to take that on as a rip, then take me on next. I released that less than a week after your last suite, I believe. Please, lets discuss the limits of intellectual property, since tit was in progress when you released yours. I just changed the highight to blue after you released Invader. My personal opinion says that I should be able to make that choice should I so chose, and if people download it since it matches your suite, then so be it. Thats just the way things go, sometimes. I doubt I'm stealing downloads from you, and its my own work, from scratch.

My personal opinion on those walls is that they should be allowed in.

I'll try to cut down on sizes and re-upload Fairyy~,thank you everyone for the support and the helpful comments. I'll be uploading it soon,as is with no decorative bars...

If all the work is yours, no, it is not a rip. If it strongly resembles something someone else has done, strictly speaking it is not a rip, could possibly be considered fan art, most probably considered gauche, depending on the artist you emulated.
If your works are similar to some readily available commercial work, such as Star Wars, etc, WC will probably have no problem with it. If it is a known skinner whose works you have 'copied', you may have a bit of an issue. A little tact would be in order. See Sleeping Dragon's post above for an example.

Of course the issue of whether your work is good enough for WC is a completely different issue.
