I think it is going to come down to whether they claim it to be their work, or if they are simply re-distributing it. The former is pretty much universally accepted as a no-no, but as we have seen here, opinions differ on the latter. In some cases we say it is okay to redistribute other people's work, and in others are motivated to prevent it. Did the Italian site in question claim the work as their own, or were they just re-distributing it with/without credit? I'm glad they decided to remove it, but I am stumped as to how we can make them, even if the law agreed that we have the right to. I'm sure there are DMCA style laws that could be used/abused to fit the need, but frankly it is holding back the ocean with a broom.
We give this stuff away freely, and our rights as to what is done with it thereafter are so fuzzy that even *we* can't agree... as we have seen in past testosterone fueled love-fests. I'd like to see us come to some sort of conclusion as a community, but I have lost the hope that it will ever matter outside the community, especially in areas where language and legal differences are barriers.
