Sorting icons on desktop outside of the Fences results in the top left space having two icons overlayed

If I have sorting turned on the is an issue with the icons on the desktop outside my fences. The attached image shows the top left space on the desktop. Whichever type of sorting I use I always end up with two icons overlayed. If I switch of sorting this automatically resets so there isn't an overlap.
